Using the store

Party Kit Pro is operated by Raviton LLC, 30 N Gould St, Sheridan, WY 82801. By browsing the site or placing an order you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the store. You must be at least 18 years old (or the age of majority where you live, if higher) to place an order or create an account. Parents and guardians are welcome to buy for children, but the purchaser must be an adult. The store is not directed to children, and we do not knowingly collect personal information from anyone under 13. Please read the section on dispute resolution and arbitration: it requires disputes to be resolved by individual arbitration and waives class actions.

Orders, prices and payment

All prices are in U.S. dollars. Shipping is added as described below, and sales tax is calculated at checkout from your shipping address.
Payments are processed securely by Stripe. We never see or store your full card number.
Placing an order is an offer to buy. We accept it when we confirm your payment, and we may decline or cancel an order, for example if an item is out of stock or the price or product details contain an obvious error, and then refund you in full.
Stock shown on the site is live. Items in your cart are not reserved until you start checkout.
Prices and promotions may change at any time, but a change never affects an order we have already confirmed.
Bundle savings and promotion codes have no cash value and apply only as shown at checkout. A code that is misused or issued by mistake may be refused.
Product photos are as accurate as we can make them. Colors can vary slightly by screen. Each kit lists what is included, and anything not listed is not part of the kit.

Shipping and delivery

Processing: orders are processed within 1 to 3 business days. We do not ship or deliver on weekends or holidays.
Delivery: please allow 7 to 14 business days for delivery after processing. These are estimates, not guarantees, and carriers can run late, so do not rely on them for a date-critical event.
Where we ship: we currently ship to addresses in the United States only.
Shipping cost: standard shipping is free on orders over $75. Orders of $75 or less pay a flat $20 shipping fee.
Tracking: you receive a shipment confirmation email with a tracking number, which can take up to 24 hours to become active.
Address: please check your address carefully. If a package is returned or must be re-sent because of an incorrect address, re-shipping fees may apply.
If we cannot ship on time: if we cannot ship within the processing time above, we will email you the new date and ask whether you agree to the delay. You may cancel for a full refund instead. If we cannot ship within 30 days of your order, we cancel it and refund you in full unless you have agreed in writing to keep waiting. We refund a cancelled order to your original payment method within 7 business days.
Lost packages: if tracking shows no delivery and your order has not arrived 30 days after it shipped, contact team@partykitpro.com with your order number. We will investigate with the carrier and send a replacement or refund you in full, including shipping.
Damaged, missing or wrong items: inspect your order when it arrives. If something is damaged, defective, missing or not what you ordered, contact team@partykitpro.com within 30 days after delivery with your order number and photos. We will send a replacement or refund you in full, including the original shipping, at no cost to you, and you will not pay for any return.

Returns and refunds

You can ask to return an item within 30 days after you receive it.
To qualify, the item must be in the condition you received it: unused, with tags and in its original packaging, with proof of purchase.
Contact team@partykitpro.com first. We reply with return instructions and a prepaid return shipping label. Items sent back without our approval cannot be accepted.
Return shipping and fees: the return label is free for you, and there is no restocking fee.
After we receive and approve a return, we refund the price you paid for the returned items (after any bundle savings or promotion code) and the sales tax on them to your original payment method within 10 business days. Your bank may need additional time to post it. The original shipping charge is refunded only when the return is because of our error or a damaged, defective or wrong item; otherwise it is not refunded.
Returned items that are damaged, used or missing parts through your handling may be refused or refunded in part, to reflect the loss in value.
Some items cannot be returned: perishable goods, custom or personalized products, personal care items, hazardous materials, flammable liquids or gases, and gift cards. Inflated balloons and opened or used decorations cannot be returned for hygiene and safety reasons.
To exchange an item, return the original and place a new order once the return is approved.

Cancellations

We process orders quickly, so we may be unable to cancel an order once it is placed. If you need to change or cancel, email team@partykitpro.com as soon as possible with your order number. If the order has not shipped, we will do our best to cancel it and refund you. If it has shipped, you can return it under the returns terms above.

Product safety

Balloons and uninflated balloon pieces are a choking hazard for young children. Adult supervision is required, and broken balloons must be discarded right away.
Keep lights, batteries and small parts away from children and never leave candles or open flames near balloons or decorations.
Follow any instructions or age warnings on the product or packaging. Kits are decorations and are not toys.

Accounts and reviews

Keep your sign-in details private and tell us if you think your account was misused. You agree not to misuse the site, interfere with it, scrape it or use it for anything unlawful. If you post a review or send us content, you confirm it is yours and truthful, and you give us a free, non-exclusive right to display it on the store and in our marketing. We may remove content that is unlawful, misleading or abusive.

Intellectual property

The site, its text, photos, designs, logos and the Party Kit Pro name belong to Raviton LLC or its licensors and are protected by law. You may view and print pages for your personal use, but you may not copy or reuse them commercially without our written permission.

Disclaimers and liability

TO THE FULLEST EXTENT THE LAW ALLOWS, THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE”, AND WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, EXCEPT THOSE THAT CANNOT BE EXCLUDED BY LAW. TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA OR LOSS OF GOODWILL, AND OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE STORE OR AN ORDER IS LIMITED TO THE AMOUNT YOU PAID FOR THAT ORDER. Some states do not allow the exclusion or limitation of certain warranties or damages, so these limits may not apply to you. Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit, and nothing here limits rights you have under consumer protection law. Decorations are used at your own risk and in line with the product safety section above. Links to other sites are for convenience and we do not control or endorse them.

Text messages (SMS)

The program: Party Kit Pro sends recurring automated marketing text messages, such as offers and cart reminders, to people who sign up for them.
How you join: by entering your mobile number in our sign-up form and submitting it. Consent is not a condition of any purchase.
Frequency and cost: message frequency varies. Message and data rates may apply, depending on your mobile plan.
Stopping: reply STOP to any message to cancel. You will receive one message confirming that you are unsubscribed, and no more marketing texts after that.
Help: reply HELP for help, or write to team@partykitpro.com.
Eligibility: US mobile numbers only. Carriers are not liable for delayed or undelivered messages.
Your data: how we use your number is described in our Privacy Policy. We never sell or share your mobile number or your text consent with third parties for their marketing.

Indemnification and general terms

You agree to defend and hold us harmless from claims, losses and costs (including reasonable legal fees) that arise from your misuse of the site, your breach of these terms, or content you submit that infringes someone’s rights, to the extent the law allows.

Entire agreement: these terms and our Privacy Policy are the whole agreement between you and us about the store.
If part is unenforceable: the rest stays in force, and an unenforceable part is replaced by the closest enforceable one.
No waiver: if we do not enforce a term right away, we have not given it up.
Events beyond our control: we are not responsible for delay or failure caused by events we cannot reasonably control, such as carrier disruption, severe weather, supplier shortages, outages or government action.
Electronic communications: you agree that we may send you order and service notices by email and that these satisfy any legal requirement that they be in writing.
California residents: under California Civil Code section 1789.3, you may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

Dispute resolution and arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. IT REQUIRES YOU AND US TO RESOLVE DISPUTES BY BINDING INDIVIDUAL ARBITRATION INSTEAD OF IN COURT, AND IT WAIVES THE RIGHT TO A JURY TRIAL AND TO BRING OR JOIN A CLASS ACTION.

Talk to us first. Before starting any claim, send a written notice to team@partykitpro.com (or to Raviton LLC, 30 N Gould St, Sheridan, WY 82801) with your name, your order number if any, what went wrong and what you want. We will try to resolve it within 30 days. A claim may start only after that period ends.
Arbitration. Except for the matters listed below, any dispute, claim or controversy between you and Raviton LLC arising out of or relating to these terms, the store, our products or your orders, whenever it arose, will be resolved exclusively by final and binding arbitration, not in court. The arbitration is administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules in effect when the claim is filed (available at adr.org), as changed by this section. The Federal Arbitration Act governs this section. The arbitrator decides questions about whether a dispute is covered and whether this section is enforceable, except that a court decides the class action waiver below.
Costs and place. You pay no more than the filing fee a court would charge you, and we pay the rest of the AAA filing, administrative and arbitrator fees. The hearing, if there is one, takes place by phone or video, or in the county where you live if you ask for an in-person hearing. The arbitrator can award you the same individual relief a court could, and must follow the law and these terms.
No class actions. You and we may bring claims against each other only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. The arbitrator may not combine more than one person’s claims and may award relief only to the individual bringing the claim. If a court finds this waiver unenforceable for a claim or request for relief, that claim or request is decided in court (in the courts named below) and the rest is arbitrated. Nothing in this section stops you from asking a court for public injunctive relief where the law of your state does not allow that right to be waived; that request is stayed until the arbitration ends.
What stays in court. Either of us may bring an individual claim in small claims court if it qualifies, and either of us may ask a court to stop infringement or misuse of intellectual property.
You can opt out. You may opt out of arbitration and the class action waiver within 30 days after you first accept these terms by emailing team@partykitpro.com with the subject “Arbitration opt-out”, your name and the address you use with us. Opting out does not change any other part of these terms.
Changes and survival. If we change this section, the change applies only to disputes that start after it, and you may reject it by emailing us within 30 days of the change. This section survives the end of your relationship with us. If it is found unenforceable as a whole, disputes go to the courts named below.

Governing law and courts

These terms, and any dispute between you and us, are governed by the Federal Arbitration Act and, to the extent it does not apply, by the laws of the State of Wyoming, without regard to conflict-of-law rules. For any dispute that is not subject to arbitration, the state or federal courts located in Wyoming have exclusive jurisdiction and you and we consent to personal jurisdiction there, unless the law of your home state requires otherwise.
